What is a Conditional Order?
A conditional order (formerly “decree nisi”) is the court’s formal confirmation that you meet the legal requirements for divorce.
The process has 2 parts:
Judge grants entitlement - the court checks your application and, if satisfied, a judge will grant you entitlement to a conditional order. This means you have passed the legal test, but the order hasn’t been made yet.
You have to apply for the conditional order separetly - even after entitlement, you must apply for a Conditional Order separately, this confirms you still wish to proceed.
It prompts the court to schedule the formal pronouncement date of a conditional order.
Without this step, your divorce case will remain on hold.
